Rent-to-Buy Terms & Conditions

1. Agreement Structure
The Rent-to-Buy program consists of two separate agreements:
A Residential Lease Agreement
An Option to Purchase Agreement (or Lease-Purchase Agreement, if applicable)
Signing these agreements does not immediately transfer ownership of the property.
2. Option Fee (Option Consideration)
The buyer-tenant is required to pay a one-time, non-refundable option fee at the start of the agreement.
This fee secures the exclusive right to purchase the property during the agreed term.
The option fee is credited toward the purchase price at closing if the buyer completes the purchase.
If the buyer does not complete the purchase, the option fee is forfeited.
3. Lease Term
The lease term typically ranges from 12 to 60 months, as agreed upon in writing.
The buyer-tenant has the right to occupy the property during this period, subject to the lease terms.
Monthly rent must be paid on time and in full.
4. Rent Credits
A portion of each on-time monthly rent payment may be credited toward the future purchase price.
Rent credits apply only if all payments are made on time and the purchase is completed.
Late or missed payments may result in loss of rent credits for that month.
5. Purchase Price
The purchase price is either:
Fixed at the beginning of the agreement, or
Determined by a pre-agreed formula or appraisal method
The purchase price is clearly stated in the Option/Purchase Agreement.
6. Maintenance and Repairs
The buyer-tenant is responsible for routine maintenance and minor repairs, unless otherwise stated.
Major structural repairs will remain the responsibility of the seller, as specified in the agreement.
The buyer-tenant must keep the property in good condition.
7. Taxes, Insurance, and Utilities
The seller remains responsible for property taxes and homeowner’s insurance during the lease term.
The buyer-tenant is responsible for utilities and renter’s insurance unless otherwise stated.
8. Financing Responsibility
The buyer-tenant is responsible for securing mortgage financing before the end of the lease term.
Approval for financing is not guaranteed and is not the responsibility of the seller.
Failure to obtain financing does not entitle the buyer-tenant to a refund of option fees or rent credits.
9. Right to Purchase
In a Lease-Option, the buyer-tenant may choose whether or not to purchase the property.
In a Lease-Purchase, the buyer-tenant is contractually obligated to complete the purchase.
All purchase notices must be submitted in writing within the timeframe specified.
10. Default
The buyer-tenant may be considered in default if they:
Fail to pay rent on time
Violate lease terms
Fail to maintain the property
Fail to close on the purchase when required (lease-purchase)
Default may result in termination of the agreement and forfeiture of option fees and rent credits.
11. No Ownership Rights Until Closing
The buyer-tenant does not gain any ownership interest, equity, or title to the property until the purchase is completed and recorded.
Occupancy alone does not create ownership rights.
12. Early Termination
Early termination by the buyer-tenant may result in loss of option fees and rent credits.
Any early termination terms must be documented in writing.
13. Legal & Professional Advice
All parties are encouraged to seek independent legal and financial advice before entering into a rent-to-buy agreement.
This program does not constitute a loan, mortgage, or guarantee of ownership.
14. Governing Law
The agreement shall be governed by the laws of the state or jurisdiction where the property is located.
Important Notice
Rent-to-Buy programs are designed to provide flexibility, not certainty. Participation does not guarantee financing approval or ownership.

Red Cat Homes is happy to provive referrals to help the Buyer-Tenant. But it is the resposubility of the Buyer-Tenant to the exclusive opprtunity to create certantly for themselves to complete the purchase at the end of the term.

This page outlines the terms of
use for communication with Red Cat Homes Ltd via WhatsApp and any other social
media platforms. Messaging platforms are provided for general communication and
convenience only and are not intended to replace formal communication channels
such as email or written correspondence.

By
communicating with Red Cat Homes Ltd via WhatsApp or social media platforms,
you acknowledge and agree to the terms outlined below.

1. Messaging
Platforms Covered by this Policy

1.1 This policy applies to
communication through messaging services including, but not limited to:

a.       WhatsApp

b.       Facebook and Facebook Messenger

c.       Instagram and Instagram Direct
Messaging

d.       LinkedIn messaging

e.       TikTok messaging

f.        
SMS text
messages

g.       Any other messaging or social
media communication platforms that may be used in future, even if not listed
above, other than our normal email address

1.2 Communication through these
platforms is considered informal
communication only
.

1.3 Messages sent through these
platforms are not monitored continuously
and responses may occur during normal office hours only.

2.3 Red Cat Homes Ltd’s
contractors may decide to work outside of office hours, but this does not mean
that we are open.

2.4 Red Cat Homes Ltd may respond
to messaging platform enquiries during office hours only.

2.5 Any verbal communication must
be backed up by written communication
via our email address, website contact form, or a signed official contract
(e.g. Serviced Accommodation Guest Agreement, Tenancy Agreement, or other
client contract).

2.6 Red Cat Homes operates a
backup mobile telephone number, 0775 1234 823, for the unlikely event that our
main line 0208 1234 823 experiences technical issues receiving maintenance
calls. This backup number is not an approved method for
reporting maintenance by WhatsApp or text message. Maintenance must not be
reported via WhatsApp or text to this number, to our main line, or to any other
mobile number used by Red Cat Homes staff or contractors. For the avoidance of
doubt, this agreement extends to all such mobile numbers and does not change or
override the Official Communication Methods set out in these Terms.

3.
Maintenance and Property Issues

3.1 Maintenance issues, repairs,
or property-related matters must not be
reported via WhatsApp or social media messaging platforms
and will not be
considered as “reported”.

3.2 Messages sent through these
platforms do not constitute official
notification
of a maintenance or tenancy-related issue.

3.3 To ensure requests are
properly logged and actioned, all maintenance and tenancy matters must be
reported via:

a.       Email to our official email
address

b.       The contact form on the Red Cat
Homes Ltd website

3.4 Failure to report issues
through the correct channels may result in delays in processing or actioning
the request.

4. Existing
Tenants

4.1 Existing tenants must not report maintenance issues,
complaints, or property matters
via WhatsApp or social media messaging
platforms.

4.2 All tenant communication
regarding property issues must be submitted via:

a.       Email to our official email
address, or

b.       The contact form on the Red Cat
Homes Ltd website

4.3 Messages sent by tenants
through WhatsApp or social media platforms may not be monitored and may not
receive a response.

4.4 Red Cat Homes Ltd cannot accept responsibility for any
maintenance issue that was only reported through messaging platforms.

5. Existing
Clients

(Landlords,
Property Investors, Contractors, Collaborators)

5.1 Messaging platforms such as
WhatsApp may be used with existing clients including:

a.       Landlords

b.       Property investors

c.       Contractors and traders

d.       Professional partners

5.2 Messaging platforms may be
used for purposes including:

a.       Operational coordination

b.       Property updates

c.       Contractor communication

d.       Scheduling discussions

e.       General business communication

5.3 Where formal instructions,
contractual matters, or legal matters are involved, Red Cat Homes Ltd requests
confirmation via email or a written agreement, other than WhatsApp or any
social media platforms.

6. New
Enquiries

6.1 For individuals who are not
yet clients of Red Cat Homes Ltd, messaging platforms may be used only for
limited purposes.

6.2 These purposes may include:

a.       Arranging property viewing
appointments

b.       Confirming meeting times

c.       Responding to basic enquiries

6.3 Messaging platforms must not
be used for:

a.       Negotiating property matters

b.       Agreeing business arrangements

c.       Reporting maintenance issues

6.4 Further communication will
normally be directed to our official email address and/or to our Official
Communication Methods.

7. No Agreements via Messaging Platforms

7.1 Any business discussions that
take place through WhatsApp or any social media platforms are considered informal communication only.

7.2 No agreement, instruction, or
business arrangement shall be considered valid or binding unless it is:

a.       Confirmed in writing via email,
or

b.       Documented in a signed written
agreement or contract

7.3 No implied agreements shall be deemed to arise from digital
communication on these platforms.

8. Voice
Notes and Audio Messages

8.1 Voice notes or audio messages
sent via WhatsApp, SMS, or social media messaging platforms are considered informal communication only.

8.2 Voice messages will not be treated as formal notification
of:

a.       Maintenance issues

b.       Complaints

c.       Instructions

d.       Agreements

8.3 Matters requiring official
notification must be submitted via email or through the official website
contact form.

8.4 Red Cat Homes Ltd cannot
guarantee that voice messages will be reviewed, stored, or processed.

9. Photos and Video Evidence Sent via
Messaging Platforms

9.1 Photos, videos, or other
media sent via WhatsApp, SMS, or social media messaging platforms may be used
for general communication purposes only.

9.2 Such media will not be considered as official
reporting
of a maintenance issue unless the matter has also been formally
reported via:

a.       Email, or

b.       The official contact form

9.3 Tenants must ensure that
maintenance issues are reported through the appropriate channels so that the
matter can be properly logged and actioned.

9.4 Red Cat Homes Ltd cannot
accept responsibility for maintenance issues that were only communicated
through photos, videos, or other media sent via messaging platforms.

9.5 Red Cat Homes Ltd accepts no liability for any matter
communicated solely through messaging platforms rather than via official
reporting channels.

10. Privacy
and Security

10.1 Messaging platforms are
operated by third-party providers.

10.2 Red Cat Homes Ltd cannot guarantee the confidentiality or
security
of information transmitted through these platforms.

10.3 Sensitive or confidential
information should not be shared through messaging platforms.

10.4 Messages or media may be
retained as part of our business records where relevant to service delivery.

 

11. Data
Storage and Record Keeping

11.1 Messages or media sent via
messaging platforms may be retained as part of Red Cat Homes Ltd’s business
records where relevant to service delivery, client communication, or legal
compliance.

11.2 Such records may be stored
in accordance with our data protection obligations and internal record-keeping
policies.

12. Changes
to this Policy

12.1 Red Cat Homes Ltd may update
this communication policy from time to time.

12.2 The latest version will
always be available on this page.

13.
Acknowledgment and Acceptance

By
initiating communication with Red Cat Homes Ltd via any messaging or social
media platform, you confirm that you have read, understood, and agreed to these
terms and conditions.
